Terms of Sale

These Terms of Sale set out the specific terms and conditions applicable to the supply of any of the products (“Product” or “Products”) listed on the Canon Online Store directed to your country of residence (our site) to you. Our Services (“Services”) listed on Canon Online Store will be governed by their special Terms and Conditions, which you will find when subscribing to the Services. Other terms such as the general website Terms and Conditions of Use and the Privacy Policy are also applicable to your use of the Canon Online Store.

Please read these Terms of Sale carefully before ordering any Products from our site. By placing an order, you are agreeing to these Terms of Sale.If you do not agree to these terms and conditions you must not order anything through our site.

1. INFORMATION ABOUT US

Our site is a website operated by Canon Europa N.V. (“Canon”, “we”, “our”, “us”). Canon is registered in The Netherlands under company number 33166721. Our registered office is at 59 Bovenkerkerweg, 1185 XB Amstelveen, The Netherlands. Our VAT number is GB398669467.

2. ORDERING PRODUCTS (OR SERVICES) FROM CANON

2.1 The following steps are required to order a Product or Service from any of our online stores and create a contract between you and us:
(i) You place the order for your products on the Canon Online Store by clicking the “Checkout securely” button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the website. Please note that your order is only a request for Products and will not constitute a contract until is handled and accepted by us.
(ii) You will receive an order acknowledgement message and email detailing the products you have ordered. This confirms we have received your request but is not confirmation or an order acceptance from us.
(iii) You will be able to pre order the items which are not yet in our stock, for instance new Products models which are still to arrive on the market. When checking out a pre-order we will initially authorise your card whilst not actually charging you for the order. This is because it might take a few weeks to ship your product and we don’t charge you for that product until we are ready to ship it. The third party payment platforms will be storing the payment details in a secure format for us. To ensure you have sufficient funds before shipment we’ll make sure to notify you via email a couple days before shipping the item to remind you that we’re about to charge your card for the full amount of the order. Both the order summary and the email confirmation will display the total sum of your order. If you don’t have sufficient funds on the card used when we’re due to ship your order, the order will unfortunately be cancelled.
(iv) Once your order has been processed and your Product is ready to be shipped from our warehouse we will send you a notice of dispatch by email. Order acceptance and the completion of the contract for the purchase of the Products takes place on the dispatch of the Products to you unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the cancellation process. The Terms of your contract will be stored by us and you will receive a copy to the email address provided when placing your order. Please, note your Order number and date for the future references.
(v) Your credit or debit card will be charged after your order is processed for dispatch and delivered.
(vi) Once an order has been processed for dispatch we can no longer stop it or make any changes. If you do change your mind about your order after submitting your order, please await arrival and simply return the Products to us in accordance with the returns process below at Clause 7.

2.2 We may not accept orders for any of the following reasons:

(i) The product you ordered is not available in our warehouse
(ii) We have not been able to obtain authorisation for your payment
(iii) There has been an obvious pricing or product description error
(iv) Where there has been a breach of any of our Terms of Sale or other applicable terms

2.3 Contracts may be concluded with us in the language(s) displayed in our site.

2.4 Canon cannot currently issue VAT Invoices to business customers in Northern Ireland, due to the fact that Northern Ireland is considered part of the EU for VAT purposes.

2.5 Please note that we sell products only in quantities which correspond to the typical needs of an average household. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity typical for a normal household.

3. ORDER CHANGES

3.1 You can cancel your order before it has been dispatched. If you have very recently placed your order and not yet received your notice of dispatch, please contact Customer Services at store.uk@cc.canon-europe.com to see whether your order can still be cancelled.

3.2 If you would like to add products to your order and it has already been dispatched, please place a new order for these items.

3.3 If your order has already been processed for dispatch or has been delivered, please follow our Returns or Cancellation processes described in Clauses 7 and 8 below.

4. PRODUCT AVAILABILITY, DESCRIPTIONS & PRICING

4.1 All orders for Products are subject to availability. We will inform you as soon as possible after receiving an order if, for any reason, the Products you have ordered are not available or are subject to any undue delay.

4.2 Whilst every effort is made to ensure the images and product descriptions on the Canon Online Store are accurate and representative of the products, the images and descriptions of the Products on our site are for illustrative purposes only and may be replaced by the current specifications of each Product. The Products that are delivered to you might vary slightly from the images and descriptions given on the Canon Online Store due to local requirements or product amendments.

4.3 All prices are displayed in the local currency of our site inclusive of VAT (where applicable) and exclusive of any delivery charges unless expressly indicated otherwise. The price of any Product may change from time to time, but changes will not affect any order we have already accepted.

4.4 We will normally verify the prices of the Products listed on our site as part of our order-handling procedure so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you.

4.5 To the extent permitted by applicable law, we are under no obligation to provide the Product to you at the incorrect (lower) price, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as an error in pricing.

5. PAYMENT

5.1 We accept payment with the payment methods listed on our site. Once your order has been handled and accepted by us, you must pay for the Products and any applicable delivery charges in advance.

5.2 By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct and that you are authorised to use the credit or debit card for the payment.

6. DELIVERY

6.1 We offer free standard delivery on all orders of £30.00 and above. Please note, this free standard delivery charge is only applicable to the final basket amount. If you would like to return your order, our returns policy gives you a 30-day window in which to send your item back free of charge, for a full refund. We aim to deliver most items within 1-3 working days, though this may take longer for remote or island locations. Direct delivery is by our approved suppliers.

6.2 Please note that we currently only accept orders for delivery to addresses within the country of the webstore you are ordering your Products from.

6.3 Your estimated delivery date will be set out in your notice of dispatch email. Although we will make every reasonable effort to ensure your Products are delivered within the estimated timescales, unfortunately we cannot guarantee that they will not be affected by unforeseen issues affecting the delivery partner. If we are unable to deliver your Product without any undue delay and within 30 days after the completion of the acceptance of your order, we will contact you with a revised estimated delivery date.

6.4 Your delivery will be completed when we deliver the Products to the address provided. If no one is available to take the delivery at the given address, the delivery partner will use standard measures to try and complete delivery. Please avoid providing your building's access code to enter your premises, Canon cannot be held responsible for possible misuse of this code by third parties. If there has been an issue with the delivery of your order, an investigation will be held by our delivery partner which will take between 8-15 working days to conclude.

6.5 You can review the current status of your order at any time by logging into your account on our site. If you have trouble finding out the status of your order or tracking its progress, please contact Customer Services at store.uk@cc.canon-europe.com .

7. CANCELLATION & RETURNS

7.1 We hope you will be happy with everything you buy from us but if you are not pleased with your Products, you can return them to us in accordance with the cancellation and returns policy described in this section.

RIGHT TO CANCEL

7.2 You have a legal right to cancel your contract between us within 30 days of the date you receive the Products without giving any reason. The cancellation period will expire 30 days from the day you take physical possession of the Product.

7.3 To exercise the right to cancel, you must inform us of your decision to cancel your contract with us by making a clear statement. Please fill in the withdrawal form, which you can find by clicking the link on the Order confirmation e-mail and email it to Customer Services at store.uk@cc.canon-europe.com making sure you include all required details of the order you wish to cancel, as set out in the withdrawal document. Then, please, send the Product back to us following the instructions on the web-site. We will consider your order cancelled only after we have either received your returned Product or the confirmation of your shipment from the shipping company.

7.4 If you wish to exercise your right of cancellation or return a non-faulty Product to us, you must take reasonable care of the Products prior to return. This means returned Products should not be used beyond what would be considered reasonable inspection and use of the Product and its functions, and thus the Products must not be damaged in any way. If the product you have purchased is faulty, you will have additional rights. To return and learn more about your rights, please, check clauses 8, 9 and 10 of these Terms.

7.5 Once you have informed us of your decision to cancel your contract with us, you must return the non-faulty Products to us within 30 days of the completed (as described in the clause 7.3.) cancellation, and we will refund the debit or credit card used for the original purchase for the full amount paid for the products, including a standard rate of the return costs, within 30 days of cancellation. Please, note that the additional costs of next day delivery charges for the return of the Products to us will not be refunded.

7.6 If there is a loss in value to any of the returned Products, and this loss is the result of inadequate handling or lack of reasonable care for the Products whilst in your possession, we may make a deduction from any reimbursement made to you.

7.7 We are generally not able to accept returns or cancellations for non-faulty products which have been made-to-order or are clearly personalised (such as photobooks).

7.8 We cannot accept returns of non-faulty Products in any circumstances other than as set out above.

8. HOW TO RETURN

8.1 To Return Products, please follow the instructions provided with your Product on delivery, see our Returns and Refunds information page, or contact Customer Services at store.uk@cc.canon-europe.com to make appropriate arrangements.

8.2 To return by post, please use the address label provided and ensure that Products are appropriately packaged to prevent damage in transportation; for high value items, we recommend you return via secure standard-rate postal methods that track your parcel and confirm our receipt.

8.3 We will process any refunds that are due, within 30 days of the cancellation receipt of the Products.

8.4 If you wish to return Products to us because they are faulty or not in conformity with the contract, please contact Customer Services at store.uk@cc.canon-europe.com.

8.5 As a consumer, you have legal rights in relation to any Products that is faulty or not in conformity with the contract. These statutory legal rights are not affected by our returns process or anything else in these Terms of Sale. For information on consumer rights, you can contact a local consumer advisory service.

9. CANON COMMERCIAL GUARANTEE

9.1 For the majority of Canon-branded products purchased via the Canon Online Store, we offer a Guarantee – a voluntary Canon manufacturer’s commercial warranty, in addition to the statutory guarantee applicable to consumers. All Canon cameras, videos and printers are covered by this Guarantee. The Guarantee is also included with some Canon accessory products (see individual product description for confirmation). We do not provide this Guarantee on non-Canon products sold at the Canon Online Store.

9.2 The Guarantee terms for all covered products is 2 year.

9.3 This Guarantee is subject to the full terms and conditions set out in Canon's European Warranty System ("EWS") which you will also find provided with your Product.

9.4 Canon's Guarantee entitles you to a remedy in the event that your Product requires a repair within due to a defect in the product. 9.5 With the exception of the Guarantee described above or any applicable commercial warranty (EWS) or other promotional warranty that may be offered by us from time to time, and without any limitation to your statutory legal rights (see below), Canon gives no other commercial guarantees with respect to any Products or Services.

10. CONSUMER STATUTORY RIGHTS AND GUARANTEES

Where you have purchased Products as a consumer you also benefit from statutory legal rights under EU and your national law covering the sale of goods that are defective or do not conform to specifications. These rights (including the right to repair, replacement or refund of the price in certain situations) apply to all consumers for 6 years on your country of purchase. These rights apply to all goods you purchase from us, and as the seller of the products, you may enforce these rights against us, whether or not your goods are covered by our Guarantee or by any other commercial warranty. 11. SALES PROMOTIONS & COMPETITIONS

11.1 We may occasionally run sales promotions or offer other incentives (“Promotions”) to purchase particular Products from us or run Competitions on the Canon Online Store.

11.2 The length of time a Promotion or Competition will run for, the specific rules or terms that will apply and the particulars of how they will apply to any such Competition or Promotion will be set out in additional terms and/or rules as shall be made available to you at that time. Other than as expressly set out in promotional terms or competition rules, these Terms of Sale will still govern the supply of Products ordered from the Canon Online Store in addition to Promotional or Competition terms.

12. YOUR INFORMATION

12.1 We process information about you in accordance with our Privacy Policy.

12.2 We will take all reasonable care to keep the details of your order and payment secure. Please note, however, that we cannot be held liable for any loss you may suffer if a third party not engaged by us procures unauthorised access to any data you provide when accessing or ordering from the website, in the absence of negligence on our part.

13. OUR LIABILITY TO YOU

13.1 In the event of a fault in our Products notified to us we will (subject to confirmation of the fault), refund, exchange or repair the Products.

13.2 The maximum loss or damage we will be responsible for under these Terms of Sale is limited to the price you have paid us for the Product to which the loss or damage you suffer relates.

13.3 We do not in any way exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation and gross negligence; (c) any breach of any terms implied by statute and we do not in any way exclude or limit our liability further than permitted by applicable law.
Nothing contained in this clause or elsewhere in these Terms of Sale limits or negatively affects your statutory rights. For information on consumer rights, you can contact a local consumer advisory service.

14. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Sale which cannot be attributed to us under these Terms of Sale, other applicable terms and conditions or applicable law, including but not limited to events outside our reasonable control including acts of god, fire, flood, severe weather, explosions, war (whether declared or not), acts of terrorism, industrial disputes (whether or not involving our employees), or acts of local or central Government or of any other competent authorities, as well as other force majeure events pursuant to applicable law.

15. DISPUTE RESOLUTION

15.1 If you have a dispute with us relating to our contract with you, in the first instance please contact us by email at store.uk@cc.canon-europe.com and attempt to resolve the dispute with us. 15.2 If we have a dispute with you relating to our contract, we will also seek to contact you directly in order to resolve the matter. We will use contact details you have provided in the relevant order or in any associated account you have registered with us.

15.3 In the unlikely event we are not able to resolve a dispute, we will discuss with you an effective way of independently resolving the dispute. This does not affect your rights to bring any dispute to court in any way.

16. CANON GROUP EMPLOYEES

If you purchase Products or Services from the Canon Online Store as a Canon Group employee, you are reminded that the Employee Store Policy is also applicable to our supply and your purchase. By placing an order, you confirm your acceptance of both these Terms and those of the Employee Store Policy.

17. UPDATES & AMENDS TO THESE TERMS OF SALE

17.1 We may modify or update these terms and conditions from time to time without notice to you. We will make available on the website an archived record of all previous versions of these terms so that you can access the ones that were applicable to you at any time.

17.2 Each time you order Products or Services from us, the current version of the terms and conditions of sale and displayed and available on our site at the time the order is submitted will be the version that apply to the contract between us.

18. APPLICABLE LAW AND JURISDICTION

18.1 These Terms of Sale are governed by English law. This means that a Contract for the purchase of Products made through our site and any dispute or claim arising out of or in connection with it will be governed by English law. If you are contracting as a consumer, the law of your country of residence will govern the above.

18.2 You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. If you are contracting as a consumer, you are entitled to bring proceedings before the courts of your domicile, in your country of residence, as applicable.

19. OTHER TERMS

19.1 These Terms of Sale set out the written terms of your contract with us for the purchase of Products and/or Services. If any paragraph or part of these Terms of Sale is found to be unlawful, invalid or is unenforceable, it shall not affect any other part of the Terms of Sale which will shall remain in full force and shall still apply to our contract.

19.2 Any contract made between you and us is only made between you and us. No third party will have any rights to enforce any of its terms.

19.3 We may subcontract or transfer our rights and obligations under our contract with you to another organisation. We will notify you if this happens if required by applicable law, but this will not affect your rights or our obligations under the contract.

21. EXPORT CONTROL

As the Customer, you confirm that you are not a blacklisted person listed on any trade embargo and/or proliferation lists; neither are you located in an embargoed country. You will not use the obtained product for any unlawful purpose and intend to use the goods or technologies purchased from the Canon Group for civil purposes only. Furthermore, you comply with all applicable laws and regulations regarding export-controlled items which might be applicable or exist independent of, and is not established or limited by, the information provided by this clause.
